The terms and conditions below, along with our privacy policy and returns/refunds policy are applicable for the whole website (kalok.labo-o-kult.com) as well as all subdomains and our online-shop and they govern our relationship with you.

General Terms and Conditions

Price

All prices are exclusive VAT, packaging costs and transport costs, if not stated contrary.
All prices are subject to change.

Packaging and Shipping

The delivery costs are charged according to the current rates of Swiss Post.
The flatrate, which is indicated for the shipping in the shopping cart, depends on the weight, volume, dimensions and packaging material of the individual products.
We assume no liability for any damage or loss in transit from the seller to the buyer.
The orders are packed as safely as possible for shipping.

Conditions of delivery

Important: The delivery of the ordered items take place only after receipt of full payment including the shipping costs.

The delivery will be made by Swiss Post and its partners abroad and it will be shipped via PostPac Economy.
As certain the products have to be produced and/or finished prior to the shipment , the delivery period is at least one week (exclusive delivery delay).
Delivery times are always non-binding.

Labo-O-Kult GmbH is not obliged to have all products in stock.
We reserve the right to change the shipping conditions at any time.

Changes / Cancellation of orders

Subsequent changes to orders that have already been confirmed are not possible.

Terms of payment 

We offer the following payment methods: prepayment and paypal. 

If you choose prepayment, you will receive the account details required for your bank transfer at the end of the order process.
If you prefer to pay your order with a deposit slip at a post office counter, please click on prepayment when choosing payment methods and request a deposit slip via our e-mail address ka@labo-o-kult.com.
Please note, that any expenses incurred in this respect and other fees shall be borne by the buyer.

Moreover it is possible to pay with Paypal, if you do not have a paypal account, you can use Paypal directly and pay with the usual credit cards (Visa, Mastercard).

For goods collected from our shop  directly, cash payments can be made,

Upon delivery you will receive a delivery note with a payment confirmation.

Retention of Title

Until the goods have been paid in full, they remain the property of Labo-O-Kult GmbH.
If the customer is in full or partial default of payment for a period exceeding 10 days, the order is automatically cancelled.

Conclusion of contract

The presentation of products in our online shop is not a legally binding offer but a non-binding online catalogue.

After entering you personal data and by clicking the button „Place Order“  in the final step of the ordering process you make a binding order of all items in the cart.
An order confirmation will be sent after placing the order.
The purchase contract is concluded with our delivery confirmation or delivery of the goods.
If you do not receive a confirmation of delivery or at least an information of an possible delay in delivery within three weeks, you are no longer bound to your order.

Despite careful checks, Labo-O-Kult GmbH does not assume liability for the topicality, correctness, completeness or quality of the information provided. The use of this information is voluntary and at the user’s own risk.
Moreover, Labo-O-Kult GmbH do not take any liability or responsibility for the content of external websites. We have no influence on the information on these websites and accept no guaranty for correctness. It is only the owners of the linked webpages who are responsible for the contents of their pages.

Limitation of Liability

We shall only be liable for losses or damage compensation claims sustained by the purchaser to the extent that we or our vicarious agents can be shown to have displayed intent or gross negligence or the damages are due to the breach of a material contractual obligation and in the case of claims pertaining to product liability.
The data communication via the Internet can not be ensured without errors at any time.
We are therefore not liable for the permanent and uninterrupted availability of our online shop nor for technical and electronic errors, on which we have no influence, especially not for the delayed processing of your orders.

Obvious mistakes, printing, calculation and clerical errors and obvious, significant mathematical errors are non-binding for us.
If the website nevertheless shows a non-obvious error, such as a syntax or arithmetic error, we reserve the right to charge the correct price at a later date.
In this case, we shall grant the purchaser an immediate right of rescission if he does not agree with the new price insofar as the ordered goods are not a special request of  the customer.
The rights of the customer under the right of revocation shall remain unaffected.

The layout of the website, the used graphics and pictures as well as the contents of this website are protected by copyright according the Copyright Act.
Labo-O-Kult GmbH reserves all property rights and intellectual property rights concerning all works (original artwork, open edition, limited edition, copies…)

Any information on this website, including copy, images and sound, are our intellectual property and must not be copied.
The copyright for all artworks  and  remains with the artist.
It is not possible to claim or purchase an exclusive copyright.
Also after the purchase of an original, a possible commercial use (virtual and/or digital) such as duplication, prints or similar has to be discussed with the artist in order to obtain an express written permission.

Data protection

Any personal data transmitted is kept in confidence and is subject to the statutory regulations on data protection. We guarantee that none of the data communicated to us is forwarded to third parties  only if necessary to process your data in order to execute your order. Certain information can be used for internal purposes and promotional purposes on our behalf.

Should individual provisions of this contract be ineffective or non-executable or become ineffective or non-executable after the conclusion of the contract, the effectiveness of the contract remains otherwise unaffected. Effective and executable rules are those with results closest to the eco- nomic objectives which the contract parties have pursued with the ineffective or non-executable provision. The existing provisions apply accordingly in the event that the contract is shown to have omissions.

Amendment to the conditions of use

Amendments to these conditions of use are published and are valid when they are placed online on the website.

Exchange / Return Policy

Purchased products will only be exchanged / withdrawn in case of provable quality defects.
These must however be reclaimed within 3 days after receipt of the goods and returned at the customers own expense.
No return of garments is accepted. Postage and shipping charges are neither credited nor refunded.

There is no refund due to damage or loss of value due to improper handling by the customer.

Originals, handmade  and/or unique items or products which are produced in small editions are excluded from any exchange.
Deviations from the screen presentation are due to the unique and  individual production of the pieces and no reason for complaint.
If there is reason for complaint, we will of course try to solve the problem, if possible.
